HopPlotter Terms of Service

Thank you for using HopPlotter (“HopPlotter,” “we,” “our,” or “us”) which helps users discover, plan and share breweries and brewery trip itineraries (the “Services”), accessible in the Apple App Store, the Google Play Store, and at https://www.hopplotter.com (the “App”). Please carefully read these terms (“Terms of Service” or “Terms”). The Terms are intended to inform you of your legal rights and duties with respect to your access and use of the HopPlotter website and any related mobile or software applications whether existing now or in the future that link to these Terms.

By accessing, browsing or using the Services, you acknowledge and accept that you have read, understand and agree to be bound by the Terms and provision of this agreement whether or not you have registered with the App. In addition, we reserve the right to change these Terms of Service from time to time without any explicit notice to you. If you do not wish to be bound by these Terms or if you do not agree to these Terms, please immediately exit the App and do not use the Services.

  1. Eligibility
    1. The App and Services are intended solely for persons who are 18 years of age or older. By accessing, browsing or using the Services you represent that you are 18 or older.
    2. If you are using the Services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such organization to the Terms, and agree to be bound by the Terms.
  2. Registration

    In order to gain access to certain features of the App and Services, you must register to create an account (“Account”). You agree to provide accurate and complete information to HopPlotter during the account registration process and to maintain the information’s accuracy and currency. You may also register to use the Services by providing credentials from certain third party social networking sites (e.g., Facebook). You confirm that you are the owner of this social media account and you authorize us to collect your authentication information, and other information that may be available on or through your social media account consistent with your applicable settings and instructions.

    1. Passwords: You are solely responsible for safeguarding your password and for any activities that occur under your Account. You agree not to disclose your password to any third party.
    2. Privacy: Our Privacy Policy (viewed at https://www.hopplotter.com/privacy) is hereby incorporated into the Terms by reference. Please closely read this policy for information regarding our collection, use, and disclosure of all personal information we receive when you register for, use, or access the Services. By accessing our App you agree to abide by our Privacy Policy and to stay informed of any changes to the posted policy.
  3. Content on the Services

    We do not endorse or guarantee the completeness, truthfulness, accuracy, or reliability of any information available via the Services including, but not limited to, brewery locations, directions, hours of operation and contact information (“Content”) available via the Services. You recognize and accept that by using the Services, you may be exposed to Content that may be offensive, harmful, inaccurate, inappropriate, mislabeled or deceptive. Under no circumstances will HopPlotter be liable for any Content.

  4. Links

    The App contains links to third-party websites and resources. You acknowledge and agree that HopPlotter is not responsible for the accuracy of the website or the content, products or services available from the websites. Links to other websites do not imply any endorsement from us of the websites or the content, products or services they provide. You acknowledge sole responsibility for all risk arising from your use of any such websites.

  5. Feedback

    You may provide HopPlotter with feedback, comments and suggestions for improvements to the App and Services (“Feedback”), including reports of failures, errors or other malfunctions you encounter. You may submit Feedback by using our feedback form accessible on every page of the App. Feedback provided to HopPlotter may be used to improve the Services. You hereby grant HopPlotter a non-exclusive, irrevocable, royalty free right and license to use, reproduce, disclose, distribute, modify and exploit such Feedback including without limitation all worldwide patent rights, copyright rights and other proprietary or intellectual property rights therein.

  6. General Prohibitions

    You agree not to do or attempt any of the following while using the App, Services or Content:

    1. Use, display, mirror or frame the App, or any individual element within the App such as the our name, our logo or other proprietary information, or the layout and design of any page or form contained on a page, without our explicit written consent;
    2. Access, tamper with, or use non-public areas of the Services, our computer systems, or the technical delivery systems of our providers;
    3. Attempt to probe, scan, or test the vulnerability of any system or network or breach any security or authentication measures;
    4. Attempt to access or search the App, Services or Content or download Content from the App or Services through the use of any engine, software, tool, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the or search agents we provide or other generally available third party web browsers;
    5. Send unsolicited or unauthorized email, promotional materials, junk mail, spam or chain letters, or other form of solicitation;
    6. Use any meta tags or other hidden text or metadata utilizing our trademark, logo, URL or product name without our express written consent;
    7. Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the App, Services or Content;
    8. Attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the App;
    9. Use the Services in violation of any applicable law;
    10. Copy, modify or distribute any computer code used in relation to the App’s functionality and owned or created by HopPlotter.

    HopPlotter holds the right to investigate and prosecute violations of any of the above to the fullest extent of the law.

  7. Termination of Use

    HopPlotter reserves the right, without any prior notice and in its sole discretion to suspend or terminate your Account at any time. You acknowledge and agree that we may block or prevent your future access to and use of the Services, and to delete all related information and files in your account. We shall not be liable to you or any third party for any damages or any other actions taken by us in connection with such termination or suspension.

  8. Indemnition

    You agree to defend, indemnify, and hold HopPlotter, its affiliates, and all of their directors, employees, agents, and suppliers from and against any and all claims, damages, costs and expenses, including, without limitation, attorneys’ fees and accounting fees arising from or related to your use of the Services, App or your violation of these Terms.

  9. Disclaimers

    Our Services and the Content available are provided on an “as is” and “as available” basis without warranty of any kind, either express or implied. Your access to and use of the Services or any Content are at your own risk. HopPlotter does not warrant materials available via the Services as accurate, reliable, truthful, error-free, complete, current or reliable. All such information, products, services and related graphics are provided “as is” without warranty or condition of any kind. HopPlotter makes no warranty regarding the quality of any products, services or content purchased or obtained through the App or Services. HopPlotter reserves the right to change any and all Content contained on the Services at any time without notice to you.

  10. Limitation of Liability

    To the maximum extent permitted by law, in no event shall HopPlotter or any of its officers, employees, agents or directors be liable to you or any third party for any direct, indirect punitive, incidental, consequential damages or any damages whatsoever including, without limitation, damages resulting from loss of use, data or profits in any way connected with the use of this App or any third party referenced or linked from this App even if HopPlotter has been advised of the possibility of damages. We shall in no form be liable in any way for third party goods and services offered through this App.

  11. Applicable Laws

    We control the App (excluding any linked sites) from our offices in the State of Washington, United States of America. We make no representations that information and materials included in the Services are appropriate or available for use in other locations. Access to the Services from any territory where the Content is illegal in any capacity is prohibited. This Agreement shall be governed in all respects by the laws of the State of Washington and any controversy or claim related to these Terms or the Services shall be exclusively submitted to the judicial courts located in King County in the State of Washington, except as otherwise agreed by the involved parties.

  12. Additional Information

    HopPlotter does in no way condone excessive drinking, driving or biking while intoxicated, and is not responsible or liable for any actions that are the direct or indirect result of drinking alcohol and/or using the Services. Please drink and use HopPlotter responsibly.
